HOUSEBOAT CAMARGUE – GENERAL TERMS AND CONDITIONS OF SALE 2025
Houseboat accommodation in the Camargue
These General Terms and Conditions of Sale (""GTC"") cancel and replace all other previously published terms of sale.
1. PRELIMINARY PROVISIONS
Article L.Article L.121-21-8 12° of the French Consumer Code stipulates that the right of withdrawal does not apply to "accommodation services, other than residential accommodation, transport services for goods, vehicle rentals, or leisure activities that must be provided on a specific date or during a specific period." The services governed by these general terms and conditions of sale are therefore subject to the aforementioned Article L.121-21-8 12°.
1.1 Definitions
In these general terms and conditions of sale (""GTC""), the following definitions apply:
- Houseboat Camargue : Houseboat Camargue, SAS, with a share capital of 1,000 euros, registered with the RCS of Nîmes under number 940 319 106, whose telephone number is 07.44.94.90.11 and the email houseboat.camargue@gmail.com.
- Website : Official website of Houseboat Camargue, accessible at the following URL: www.houseboat.camargue.com.
- Houseboat: boat moored in Camargue, fitted out for the accommodation and relaxation of customers, with the equipment and services listed on the booking site.
- Client : any natural or legal person with whom Houseboat Camargue enters into a contract for the sale of tourist services, hereinafter collectively referred to as the "Parties", and individually as a "Party".
- Order : any contract binding the Client to Houseboat Camargue for the realization and execution of the sale of tourist services and accommodation on board a houseboat.
1.2 General Information
These General Terms and Conditions apply to any order placed via the website, by telephone or by email, for the reservation of one or more houseboats and related services offered by Houseboat Camargue, it being specified that said services can only be used for the date(s) chosen by the Customer when placing the Order and that any order implies the express and unreserved acceptance by the Customer of all of these general terms and conditions of sale, which are available at any time on the Houseboat Camargue website.
1.3 Internet
- The Client declares that they have the legal capacity to enter into this contract, i.e., that they are of legal age and not under guardianship or curatorship.
- Placing the Order implies unreserved acceptance of all the clauses and conditions provided for in these General Terms and Conditions, the Client declaring to have full knowledge thereof and therefore waiving the right to rely on any other document.
- Houseboat Camargue reserves the right to unilaterally modify these Terms and Conditions at any time and to apply them to all Orders placed after the date of modification.
1.4 Commands
- Orders are subject to these Terms and Conditions and the internal regulations applicable on board the houseboats.
- To place an order, each Customer must select the desired houseboat, the date and time of departure or arrival if applicable, as well as the desired additional services; before definitively registering their order, the Customer will have the opportunity to check their selection and modify it as they see fit, the order being definitively registered only upon the final validation of the order summary screen, this last "click" being considered equivalent to the handwritten signature referred to in Article 1341 of the Civil Code (hereinafter referred to as "the acceptance click").
- From the moment the acceptance click indicated above is made, the order is considered irrevocable and can only be challenged in the limited cases provided for in these Terms and Conditions, the Customer being able to identify and correct any error before this last click.
- Upon order registration, the Customer will be automatically redirected to a page confirming the final validation of their order and will also receive a confirmation email, which can be saved or printed, serving as proof of reservation.
- The Customer is guaranteed that their bank account will only be debited once via the secure Houseboat Camargue website, for the total amount of the order.
- In accordance with Article L.121-20-4 2° of the Consumer Code, the Customer does not benefit from the 7-day withdrawal period provided for in Article L.121-20 of the same Code.
2. ACCEPTED PAYMENT METHODS
For flexible rates (cancellable free of charge up to 7 days before the stay – 50% payment at the time of booking and balance at D-7), only payments by bank card (Visa, Mastercard, Carte Bleue) are accepted.
For non-refundable and non-modifiable rates (100% at the time of booking):
- If the stay takes place more than 30 days after booking, the accepted payment methods are: bank card, ANCV paper or Connect holiday vouchers, and bank transfer.
- If the stay takes place less than 30 days after booking, only payments by credit card and ANCV Connect are accepted.
Payment of the price via the website is made directly to Houseboat Camargue, using the Client's bank card number through a secure payment system.
3. MODIFICATION – CANCELLATION OF STAY BY THE CLIENT
The conditions for modification and cancellation depend on the chosen rate.
Flexible pricing:
- Changes are possible up to 7 days before the arrival date, only for dates where the flexible rate is offered. If the revised rate is higher, the difference will be charged to the customer; if the rate is lower, no refund will be issued.
- Cancellation : Free up to 7 days before arrival. After this period, no refund will be issued and the balance remains due. In case of no-show, no payment will be refunded.
Non-refundable and non-modifiable rates:
- Modification : impossible.
- Cancellation : No payments will be refunded. In case of no-show, no service will be refunded.
Cancellation insurance: Clients are strongly advised to purchase cancellation insurance from an insurance company, especially if payment was made using non-refundable methods. Some bank cards offer cancellation insurance, subject to the issuer's terms and conditions.
4. GIFT VOUCHERS
Gift vouchers can be for a specific amount or in the form of packages offered by Houseboat Camargue. Package prices are indicative and calculated based on the average houseboat rate. The gift voucher code is valid for two years from the date of purchase; after this period, no refunds or extensions will be possible. The recipient can make their reservation on the date of their choice, subject to availability, and any price difference will be their responsibility.
5. CANCELLATION BY HOUSEBOAT CAMARGUE
- In the event of force majeure or exceptional and unavoidable circumstances (severe weather, storms, weather alerts, epidemics, etc.), Houseboat Camargue reserves the right to cancel the stay. If another houseboat is available, it will be offered at no extra charge. Otherwise, a voucher valid for 18 months or a full refund will be offered. No further compensation may be claimed.
- Access to the houseboat or onboard activities does not constitute a guarantee of specific service in the event of high demand or events beyond the control of Houseboat Camargue.
- In the event of equipment failure or technical service failure (heating, electricity, hot water, etc.), Houseboat Camargue will endeavor to offer a replacement service to ensure the smooth running of the stay.
6. RATES
The descriptions of services indicate, for each houseboat and option, the services included in the price. Only the services explicitly mentioned are part of the package. Prices are quoted in euros, inclusive of all taxes, unless otherwise stated. Services not expressly mentioned (meals not included in the package, drinks, additional services, transportation) are at the customer's expense. Prices are subject to change at any time; however, changes will not apply to reservations already confirmed.
7. ACCOMMODATION CAPACITY
The number of people indicated for each houseboat corresponds to the maximum occupancy allowed due to available equipment and safety requirements. This maximum capacity cannot be exceeded, and the price is calculated proportionally to the actual number of occupants. For multi-night stays, all guests on the same houseboat will stay the same number of nights.
8. CHILDREN
The presence of children under 3 years old must be indicated when booking. Children remain the responsibility of their parents or guardians.
9. CONDITIONS OF STAY
- The Client agrees to maintain peace and quiet on board between 10pm and 8am, to use the houseboat without taking risks, without causing noise or damage, and not to introduce any illicit substances or outside alcohol.
- The Client must return the houseboat in a satisfactory state of cleanliness; in case of excessive dirt or damage, charges may be applied.
- Minors must be accompanied by an adult.
10. SECURITY DEPOSIT
A security deposit will be required upon arrival to cover any potential damage or missing items. This deposit will be paid by credit card and released after the houseboat has been inspected upon the client's departure. For banks outside of France, the release period may be up to 30 days.
11. VALUABLES
Houseboat Camargue recommends not leaving valuables on board and locking the doors when you are away. The client remains responsible for their belongings and is advised to take out specific insurance.
12. RESPONSIBILITY
Houseboat Camargue may be relieved of all or part of its liability when the poor performance of the contract is attributable to the Client, to the unforeseeable and insurmountable act of a third party, or to a case of force majeure. The Client is responsible for any direct or indirect damage caused on board, to personnel, or to equipment.
13. CLAIM
Any incident must be reported to the team immediately. Any other type of complaint must be submitted within 15 days by email or registered mail with acknowledgement of receipt.
14. APPLICABLE LAW
These terms and conditions are governed by French law. Any dispute will be brought before the competent courts.
15. INTERNAL REGULATIONS
- Customers must comply with the internal regulations and safety instructions on board.
- It is strictly forbidden to bring unauthorized animals, weapons, dangerous substances or rolling stock on board.
- Any violation of the rules may result in the Client's exclusion without refund.
- Respect for the environment, peace and quiet and other boaters is mandatory.
